Other than stated in this statement, Lyne Gatty Real Estate does not rent, sell or otherwise disclose your personal information to non-member companies or organisations without having first obtained your consent to do so.

TERMS & CONDITIONS OF HOLIDAY RENTAL 

1. GENERAL TERMS AND CONDITIONS
a. Animals are not permitted unless requested & approved at time of booking.
b. Bed linen and towels are NOT provided unless otherwise advised. Blankets / Doonas and pillows are provided. You are required to bring bed sheets and pillow cases. (Bed Linen is provided at select properties upon request – please confirm with agent in writing).
c. All holiday properties are strictly non-smoking internally.
d. A non-refundable booking fee of $30.00 is payable for all bookings.
e. Bookings made via third party websites may incur further additional charges which will be included in the total cost of tariff.
f. Guests will be required to provide valid photo ID (Australian Drivers Licence, RMS ID card or Passport) and provide vehicle registration details during check in procedure. After hours check in is only available if valid ID has being provided beforehand and / or the online ‘after hours’ check in form completed.
g. All Properties are privately owned – as such, all bookings are taken in good faith on behalf of the Property Owner. The Property Owner reserves full rights to cancel any booking without notice. A full refund will be provided.
h. FAILURE OF SERVICES OR EQUIPMENT/APPLIANCES – We make every effort to ensure the property is ready for you to enjoy your stay. Where a problem is experienced (eg by failure of equipment such as dishwasher, washing machine, air conditioner, hot water service, TV, toaster or kettle or services such as power, water) please report it to us by phone, text or email. We will do our very best to get the item or serviced fixed, restored or replaced as quickly as possible. However, it may not always be possible to achieve this during your stay. This is not grounds for a refund or compensation for any loss you may have incurred.

2. PAYMENTS
a. A 50% deposit plus booking fee is due and payable within 3 days of booking. Any 3rd party charges (eg, additional fees attracted through the use of the stayz website) are also included in the deposit if applicable. Reservations will be cancelled if deposit is not received by the due date.
b. Full payment is required if your arrival is within one month of booking.
c. The balance of your payment is required one month prior to your arrival during off peak times and two months prior to arrival during peak times (summer school holidays).

We accept payments made via Electronic Funds Transfer (EFT) into our Trust Account. Payments may be made online using your own internet banking or in branch and any Commonwealth Bank (BSB & Account Number will be supplied). We do not have credit card facilities and do not accept cash.

Payment via Credit Card is only available to reservations made through the HomeAway network using the SecurePay Service. Please check the Terms & Conditions regarding how your details are secured / stored direct with the HomeAway site during your transaction.  Lyne Gatty Real Estate does not have access to, nor does it store any payment details.

3. CHECK IN / CHECK OUT & KEY COLLECTION
a. A representative of Lyne Gatty Real Estate will meet you at the property on arrival to complete check in procedures. We ask that you contact us on 0408 476 150 – 15 minutes prior to your arrival to facilitate this. (Contact us from MORUYA if traveling from the North – or from BODALLA if you are traveling from the South).
b. This form must be signed on arrival with all required details supplied including showing valid photo ID OR the online Terms and Conditions form & Check in must be completed prior.
c. PEAK SEASON (December / January school holidays) CHECK-IN time is from 2pm and CHECK-OUT by 10am.
d. OFF PEAK SEASON (all times excluding December / January Holidays) CHECK IN time is from 1pm and CHECK OUT by 11am.
e. If you plan to arrive after 4pm (or 2pm on Sundays) – please contact our office 24 Hours prior to allow for after-hours key collection arrangements to be made.
Arrival and departure times may be varied with prior written approval and are subject to other guest bookings, housekeeping requirements / availability or housekeeper.

Approval for varied times is given in ‘good faith’ however Lyne Gatty Real Estate reserves the right to cancel ‘early’ or ‘late’ check in approvals if required (eg – a late booking has being taken the day prior to your departure, we may have approved your request to check out t 12pm, however now that we have guests arriving the same day as your departure we would have to cancel the late check out to allow for housekeeping prior to next guest arrival).

4. AFTER HOURS CALL OUTS / PROPERTY LOCK OUTS
a. For after-hours assistance, a call out fee of $50.00 will be payable for all non-urgent matters such as lost keys or property lock outs.
b. No attempt is to be made to break into the premises when locked out. In the event of a lock out, please contact Lyne Gatty on 0408 476 150 – we will use our office master key to allow you to re-gain entry to the property. Please Note: we can only provide access to the person(s) named in the booking paperwork and valid photo ID will be required (Drivers Licence, RMS ID card or Passport only)

5. SECURITY DEPOSIT / DOG BOND
a. Certain properties may require a SECURITY DEPOSIT of $200.00 to be paid. The bond will be refunded within 7x days of your departure unless withheld to cover any damages / breakages or loss by way of EFT transfer only. You will be required to provide your account details for refund.
b. All bookings which include a dog will be require a refundable dog bond of $100.00 (in addition to security bond where required). The Property cleaner will advise the bond status following your departure. The bond will be refunded within 7x days of your departure unless withheld to cover any damages / breakages or loss / additional cleaning (eg dog fur etc) by way of EFT transfer only. Bank details (BSB, account number etc will need to be supplied)

6. HOUSEKEEPING / DAMAGES / BREAKAGES / LOSSES
a. Please leave the property in the condition that you found it in. A standard clean will be provided but anything outside a standard clean will be charged or taken from your bond. A $50.00 BBQ cleaning fee will be charged if you leave the BBQ unclean. A $50.00 dog waste fee will be charged if you do not clean up after your dog (at applicable properties only).
b. All damages, breakages or losses to the property, furniture and furnishings are to be reported immediately to Lyne Gatty Real Estate. Any damages, breakages or losses caused will need to be paid for. If a bond has been paid we will deduct any amount due from this.
c. Guests should advise Lyne Gatty Real Estate of any faults or breakages discovered on arrival. If we are not advised we will consider damages to the responsibility of the current guest and charge accordingly.
d. We do hope that you catch plenty of fish but they are NOT to be cleaned at the holiday. There are excellent facilities located at the boatshed / boat ramp area for this purpose.

7. GARBAGE / WASTE
a. The RED bin is for household waste – collected weekly early Tuesday morning (put out on kerb Monday night). This bin is for general household waste.
b. The YELLOW bin is for recyclable items only – collected fortnightly early Tuesday morning (put out on kerb Monday night)
c. The GREEN bin is for garden waste ONLY.
Excess garbage must not be left at the property or placed in the inappropriate bin. You will be charged up to $100.00 for excessive rubbish removal should this occur.

8. LICENCE TO OCCUPY
a. Guest(s) are granted a limited permission to occupy the Property for holiday purposes for the duration outlined on page 1 of this document.
b. This is not a residential tenancy agreement under the residential tenancies legislation; and
c. Failure to comply with the Guests obligations in the Terms and Conditions may result in termination of permission to occupy the Property and eviction.

9. MAXIMUM NUMBER OF GUESTS AND VISITORS
a. The maximum number of guests permitted to stay overnight at the Property must not be exceeded. This information is available in all advertising material relating to the property as well as by asking the Managers at Lyne Gatty Real Estate on (02) 4473 9253 or [email protected]
b. The maximum number of visitors is 5 and must not be exceeded.

10. GENERAL OBLIGATIONS OF ALL GUESTS AND VISITORS
a. Comply with all House Rules (and By-Laws if applicable);
b. Respect the residential amenity and security of the Property and neighbours;
c. Refrain from anti social behaviour;
d. Guests must control and be responsible for Visitors and ensure that Visitors comply with both the Terms and Conditions as well as House Rules;
e. Comply with instructions from the Manager and / or Security Services during your stay; and
f. Notify the Manager of any disputes or complaints as soon as is practical.

11. NOISE AND RESIDENTIAL AMENITY
a. Guests must not create any noise which is offensive to neighbours – especially between the hours for 10pm and 8am, as well as during arrival and departure to and from the Property anytime during occupancy.
b. Offensive noise is prohibited and may result in;
i. Termination of permission to occupy the Property;
ii. Eviction;
iii. Loss of rental paid; and
iv. Extra charges for security and other expenses which may be deducted from your security deposit or charged accordingly if security deposit is not applicable.

12. FUNCTIONS AND PARTIES
a. The Property is not a “Party House” and any such activities are strictly prohibited; and
b. Any gathering, celebration or entertainment permitted at the Property must not conflict with the residential amenity and must comply with all Terms and Conditions as well as House Rules.

13. ACCESS AND PARKING
a. Guests and Visitors must comply with parking regulations (NSW ROAD RULES REGARDING PARKING – (eg at least 3m from the centre line – DO NOT SIMPLY BLOCK THE ENTIRE LANE) and show consideration to neighbours.
b. Guests must not park on roadways or footpaths.
c. Guests are to follow HOUSE RULES in regards to parking areas at the Property.
d. Vehicles parked at Properties (either in Driveway, Garage, Carport or Yard) are done so at the Guests or Visitors own risk.
e. Guests will be required to provide vehicle registration details upon request.

14. WHAT TO BRING
a. All Properties are fully self contained; however personal requirements and consumables are not supplied. Please refer to Property details for further information.
b. Please bring bed linen (unless supplied at property – please confirm at time of booking), towels and tea towels. Pillows and quilts are supplied.
c. For Health and Hygiene reasons, linen MUST be used on all beds (Do not sleep directly on mattress protectors). Additional cleaning fees will apply.
d. Whilst we do aim to supply a start up amount of washing up liquid, dishwasher tables, sponges, wc paper etc, it is expected that guests will obtain their own supply to last the duration of their stay.
e. Generally, nothing is provided in the way of food stuffs or bathroom products.

15. ON DEPARTURE – PLEASE DO NOT TURN OFF HOT WATER, POWER OR FRIDGE ON DEPARTURE
a. You must leave the Property in a ‘Clean & Tidy’ condition. Failure to do so will result in additional cleaning charges.
i. Empty all rubbish bins. Please note clause 7!
ii. Wash, wipe and put away all dishes (including unpacking the dishwasher)
iii. Remove any food scraps and clean the BBQ
iv. Remove all food stuffs from the fridge and freezer. Wipe out any spills.
b. Lock all doors and windows.
c. Return keys to Lyne Gatty Real Estate.

16. CANCELLATION POLICY
a. If a replacement booking can be secured, all monies paid are refundable less the booking fee of $30.00 and a $100.00 administration fee as well as any 3rd party booking fees (ie – stayz, homeaway network etc)
b. If the property cannot be re-booked, all monies paid are not refundable.
c. Shortened stay – the unused portion of rental is not refundable.

16. CONSEQUENCES OF NOT MEETING THE TERMS AND CONDITIONS
a. The consequences of not complying with the Terms and Conditions requirements can include action from the Owner, Manager, Security Services, local council or in some instances, the Police.
b. Enforcement action is subject to the Australian Consumer Law and other relevant legislation.
c. Such enforcement action could result in termination of Permission to Occupy the Property, eviction, loss or rent paid, deductions from security deposit and extra charges.
d. It is there for important for all Guests to be aware of their obligations and of their responsibility to maintain the amenity of the Property and its neighbourhood.
17. AGENT DISCLAIMER – Bookings are taken in good faith on behalf of the owner of the property. At time situations arise over which Lyne Gatty Real Estate has no control. We cannot be held responsible for cancellations or changes made by the owner of the property. The description of the premises by the agent is made in good faith and no responsibility for misrepresentation can be accepted. DEFINITIONS
Holiday Rental means rental of Property for holiday purposes within the maximum term permitted for rental without a residential tenancy agreement under state and territory residential tenancy legislation.

Dwelling means any room or suite of rooms occupied or used so constructed or adapted to be capable of being occupied or used as a separate domicile.

Guest means a person who stays overnight at the Property during the term of occupancy.

Manager means the Owner or another person appointed by the Owner such as a real estate agent (Lyne Gatty and Jay Gatty) who is responsible for renting the Property.

Noise means any sound which is offensive to occupiers of neighbouring properties.

Owner means the person or entity who owns the Property. It includes the lessee of a Property who sublets or licences it to others for Holiday Rental.

Property means Dwellings and residential premises including houses, dual occupancies, villas, townhouses, apartments, units, secondary dwellings, cabins and the like generally with a maximum of 6 bedrooms unless relevant local council permits holiday rental in properties with more than 6 bedrooms.

Visitor means a person a Guest invites or permits to visit the Property during the term of occupancy tho does not stay overnight.
